These Terms and Conditions of Sale (hereinafter referred to as "Terms") apply to any purchase made by a natural person acting as a customer (hereinafter the “Customer”) through the website rethrowbackstudio.com (hereinafter the “Site” or “website”), from Rethrowback Studio, a sole proprietorship governed by French law (entrepreneur individuel), registered with the RCS Pontoise under SIRET number 928 162 783 00015 (hereinafter the “Seller” or "We")

By placing an order on the Site, the Customer declares having read, understood, and accepted these Terms without reservation.

IMPORTANT: The Customer declares to have read and accepted these Terms prior to placing an order. Order confirmation implies full and unconditional acceptance of these Terms.

Article 1 – Scope and Validity of the Terms

These Terms apply exclusively to all sales of products and services made through the website rethrowbackstudio.com, operated by Rethrowback Studio.

They govern the contractual relationship between Rethrowback Studio (the « Seller ») and any Customer making a purchase via the Site.

These Terms apply without restriction or reservation to all orders placed on the Site, regardless of the Customer’s country of residence, and prevail over any other terms or conditions, unless expressly agreed in writing by the Seller.

The Customer declares to have read and accepted these Terms prior to placing an order. Order confirmation implies full and unconditional acceptance of these Terms.

Rethrowback Studio reserves the right to update or modify these Terms at any time. The version applicable to the Customer is the one in force at the time of order confirmation. A dated version of the Terms is always available on the Site.

Article 2 - Products

The products offered for sale on rethrowbackstudio.com include both:

  • Second-hand photographic equipment, such as cameras, camcorders, lenses, and related gear;

  • And brand-new accessories, including (but not limited to) SD cards, USB adapters, film rolls, and camera cases.

2.1 – Second-hand Products

All second-hand products listed on the Site are carefully sourced,, refurbished, and fully tested prior to sale.

Each item is assigned a condition rating from 7 to 10, based on its cosmetic and functional state.

Any signs of use, cosmetic flaws, or functional particularities are clearly mentioned in the product description, and illustrated through actual photos of the item being sold.

All second-hand items are unique, available in single quantity, in the condition described.

Photos strive to reflect the true colors of the products, but slight variations may occur depending on the Customer's screen settings.

Rethrowback Studio is committed to providing accurate, honest, and detailed product listings. The Customer is expected to carefully read the description and condition rating and examine the photos before placing an order.

If any clarification is needed, the Customer is invited to contact Rethrowback Studio prior to completing the purchase.

2.2 – New Products

New products offered on the Site are clearly identified as new, unused, and sold in their original condition.

They may be available in multiple quantities and may be restocked.

2.3Use of the Products

The Customer is solely responsible for the proper use, handling, and operation of the Products.

Rethrowback Studio cannot be held liable for any damage, malfunction, injury, or loss resulting from improper use, incorrect handling, misuse, neglect, or unauthorized modification.

In particular, vintage and second-hand electronic products require careful handling and appropriate use. The Customer acknowledges that improper use, excessive force, exposure to moisture, sand, heat, or electrical incompatibility may cause damage and void any applicable warranty or return rights.

Article 3 - Prices

All prices displayed on rethrowbackstudio.com are listed in euros (€).

VAT is not applicable, in accordance with Article 239B of the French General Tax Code. Rethrowback Studio operates under the French VAT exemption scheme for small businesses (franchise en base de TVA)

Prices may vary depending on stock availability, sourcing costs, or product condition. For second-hand products, each item is unique and individually priced based on its condition and market value.

Product prices correspond to those in effect at the time the Customer places the order.

In the event of an error in the listed price (e.g., typographical or system error), Rethrowback Studio reserves the right to cancel the affected order(s), even if payment has already been received. In such cases, the Customer will be promptly informed and refunded.

Rethrowback Studio reserves the right to change prices at any time; however, the price applicable to the Customer is that shown at the time of order confirmation.

Shipping fees are not included in the product prices and will be calculated and displayed at checkout based on delivery address, package weight, and selected shipping method.

IMPORTANT: any customs duties, import taxes, or local fees imposed by the destination country are the sole responsibility of the Customer. Rethrowback Studio cannot be held liable for these charges.

EXCEPTION – UNITED STATES: Orders shipped to the United States are sent Delivery Duty Paid (DDP). All applicable duties and import taxes are included in the final price displayed at checkout. No additional payment is required upon delivery.

Article 4 - Orders

The Customer places an order online via the website rethrowbackstudio.com by selecting products and completing the checkout process. By validating the order, the Customer confirms their full and unreserved acceptance of these Terms and Conditions of Sale.

Once the order is placed, the Customer receives an automatic confirmation email summarizing the order details. This email constitutes proof of the contract between the Customer and Rethrowback Studio.

Rethrowback Studio reserves the right to accept or refuse any order for legitimate reasons, including but not limited to product availability, incorrect pricing, or suspected fraudulent activity. In case of refusal, the Customer will be notified by email, and any payment made will be refunded promptly.

Given the nature of second-hand products, availability is limited to the stock shown on the Site at the time of order. Orders for out-of-stock items cannot be accepted or will be canceled.

The sales contract is considered concluded upon Rethrowback Studio’s confirmation of the order by email.

Article 5 - Payment

The Customer can pay for their order using the payment methods available on rethrowbackstudio.com, such as credit/debit cards, or any other secure online payment systems displayed at checkout.

Full payment is required at the time the order is placed. The order will not be processed or shipped until payment is successfully received.

Rethrowback Studio ensures that all payment transactions are securely processed using encryption and trusted payment gateways to protect Customer information. Payment data is encrypted and processed directly by the secure provider, without passing through Rethrowback Studio’s servers. By providing payment details, the Customer authorizes Rethrowback Studio to charge the full amount of the order.

Any failed or unauthorized transaction will result in automatic cancellation of the order.

The Seller reserves the right to refuse or cancel any order in case of suspected fraud, abusive behavior, or ongoing dispute with the Customer.

Article 6 – Shipping and Delivery

As part of our quality assurance process, each order is filmed during final functional testing and packaging.

This process allows Rethrowback Studio to verify the condition of the Product in the event of any claim, dispute, or issue reported after delivery, ensuring full transparency and customer satisfaction.

6.1 – Delivery Terms

Products may be delivered to any address worldwide, as specified by the Customer at the time of purchase. The Customer is solely responsible for the accuracy, completeness, and validity of the delivery information provided, including the recipient’s name, full delivery address, and any additional details required to ensure proper delivery (such as access codes, building information, or special instructions, where applicable).
The Customer undertakes to provide all information necessary for the successful delivery of the Products.
Rethrowback Studio cannot be held liable for delivery delays, failed deliveries, or the return of parcels resulting from incorrect, incomplete, or inaccurate delivery information, or from the impossibility of delivering to the address indicated.
In the event that a parcel is returned to Rethrowback Studio due to such reasons, the Customer may be required to cover additional shipping costs for reshipment.

6.2 Estimated Delivery Times
Estimated delivery times are provided for informational purposes only and depend on the carrier, destination, and local conditions.

Rethrowback Studio will make reasonable efforts to process and dispatch orders within one (1) to three (3) business days following order confirmation, excluding weekends and public holidays, unless otherwise stated or in cases of force majeure.

Delays beyond the estimated delivery times do not give the Customer the right to cancel the order or claim damages.
Rethrowback Studio uses reliable third-party carriers and selects shipping methods based on product size, weight, and destination. The chosen shipping method will be indicated during checkout.

Customers can track their orders online. If the Customer does not receive the package within a reasonable time after the estimated delivery date, they should contact Rethrowback Studio promptly to investigate. Rethrowback Studio is not responsible for delays caused by the carrier, customs, or force majeure events

6.3 Shipping Costs and Risk Transfer
Shipping fees are borne by the Customer and displayed before finalizing the order.

IMPORTANT: for orders shipped outside the European Union (e.g., to the United States), the Customer is responsible for all customs duties, import taxes, and other applicable fees at the destination. Customers are strongly advised to check applicable customs regulations and potential additional charges before placing an order.

The risk of loss or damage to the Products is transferred to the Customer at the moment when the Customer, or a third party designated by the Customer and other than the carrier, takes physical possession of the Products.

Products must be carefully inspected upon reception. If the Products arrive damaged or faulty, the Customer must immediately contact Rethrowback Studio following the procedures set out in the Return Policy. 

Article 7 – Right of Withdrawal (Cooling-off Period)

The Customer has a legal right to withdraw from the purchase within 14 calendar days starting from the day the product is received.

To exercise this right, the Customer must first notify Rethrowback Studio of their decision to withdraw via a clear and unambiguous statement expressing their intention to cancel the order. The notification must be sent using the contact form provided on the website or via rethrowbackstudio@gmail.com
Any return made without prior contact will not be accepted. 

Once the decision to withdraw has been communicated and accepted by Rethrowback Studio, the Products must be returned to the address provided by Customer Service within 14 days of that notification. The Customer is responsible for the cost of returning the Products, unless otherwise instructed by Customer Service.

Returned products must be in their original condition, unused (unless defective), returned with all original packaging and accessories, unless otherwise specified in the return policy, and accompanied by the invoice.

The detailed terms and conditions for returns and refunds are set out in Rethrowback Studio’s Return Policy, which the Customer should consult before initiating a return.

Certain products may be excluded from the right of withdrawal as specified in the Return Policy (e.g., opened consumables such as film rolls or SD cards).

In case of withdrawal:
• The product price and standard outbound shipping costs will be refunded,
Return shipping costs remain the responsibility of the Customer, except in cases of defective or incorrect Products as details in the Return Policy.

Article 8 – Returns and Refund Policy

Any return of products must be authorized in advance by Rethrowback Studio. The Customer must contact Rethrowback Studio to obtain a return authorization and instructions.

Products returned must be in the same condition as received, unused, and returned with all original packaging, accessories, and documentation.

Unless the return is due to an error by Rethrowback Studio (wrong product, defective item), the Customer is responsible for the costs of returning the product.

Once the returned product is received and inspected, Rethrowback Studio will process the refund within 10-14 business days. Refunds will be made using the same payment method as the original purchase, unless otherwise agreed.

Certain items are excluded from returns due to their nature, including but not limited to: opened consumables (film rolls, opened memory cards), custom or personalized products, and products damaged by improper use or handling by the Customer.

If the product is defective or does not conform to the description, the Customer must notify Rethrowback Studio immediately upon receipt to arrange a replacement, repair, or refund.

Article 9 – Legal Warranties

Independently of any commercial warranty that may be granted, Rethrowback Studio remains liable for legal warranties provided under French law, in particular:

  • the legal warranty of conformity, in accordance with Articles L.217-3 to L.217-20 of the French Consumer Code (Code de la Consommation);

  • and the legal warranty against hidden defects, in accordance with Articles 1641 to 1649 of the French Civil Code

These legal warranties apply to second-hand and refurbished electronics products, including cameras, camcorders and photographic equipment sold on the Site.

9.1 – Legal Warranty of Conformity

Rethrowback Studio guarantees that the products sold comply with the contract and are free from defects at the time of delivery.

The Customer benefits from a legal warranty of conformity for a period of two (2) years from the date of delivery of the Product.

However, in accordance with Articles L.217-7 of the French Consumer Code, any lack of conformity that appears within twelve (12) months from delivery is presumed to have existed the time of delivery, unless proven otherwise.

In the event of a lack of conformity, the Customer may choose between: 
• repair, or
• replacement of the Product,

in accordance with Article L.217-9 of the French Consumer Code, unless one of these options results in a manifestly disproportionate cost for Rethrowback Studio.

If repair or replacement is impossible, the Customer may request:
• a partial refund of the purchase price, or
• termination of the contract, in accordance with Article L.217-10 of the French Consumer Code

The legal warranty of conformity does not cover:
normal wear and tear,
• defects disclosed at the time of sale,
• damage resulting from improper use, handling, modification, or misuse of the Product.

9.2 – Legal Warranty Against Hidden Defects

The Customer may also rely on the legal warranty against hidden defects as defined in Article 1641 of the French Civil Code, provided that defect: 
was hidden,
• existed prior to the sale,
• and renders the Product unfit for its intended use or significantly reduces its use

In this case, the Customer may choose either to return the product and obtain a full refund of the purchase price, or to keep the product and obtain a partial refund corresponding to a reduction in the sale price.

This action must be brought within two (2) years from the discovery of the defect. 

9.3 – The legal warranty of conformity does not apply if:

the Customer was aware of the defect at the time of purchase,

the Customer could not reasonably have been unaware of the defect,

the defect results from materials supplied or added by the Customer,

the defect arises not from the product itself but from improper use of the product.

These warranties are in addition to any other rights the Customer may have under applicable consumer protection laws.

These legal warranties do not cover damage caused by improper use, accidents, normal wear and tear, or modifications by the Customer.

The Customer must provide supporting evidence (photos, videos, descriptions) when invoking a warranty claim.

When submitting a warranty claim, the Customer is invited to clearly describe the defect, lack of conformity, or damage observed, and to provide any supporting evidence that may assist in the assessment of the claim (such as photos, videos, and a detailed description of the issue).

Article 10 - Liability

Rethrowback Studio’s liability is limited to the direct damages caused by proven negligence or fault in the performance of its contractual obligations.

Rethrowback Studio shall not be held liable for:

Indirect or consequential damages, including loss of profits, loss of data, or loss of use.

Defects or issues resulting from improper use, neglect, accidents, or unauthorized modifications by the Customer.

Delays or failures in delivery caused by carriers, customs, or events beyond Rethrowback Studio's control (force majeure).

Any customs duties, import taxes, or fees imposed by the Customer’s country.

Refurbished products are sold after having been professionally inspected, cleaned, and restored to proper working condition by Rethrowback Studio. Each item has been thoroughly tested to ensure full functionality and accurately described. The Customer accepts that minor cosmetic imperfections may remain, without affecting the performance or reliability of equipment.

Any reproduction or use of this content without prior written authorization is prohibited.

Rethrowback Studio is not affiliated, associated or officially connected with any of the brands mentioned or sold on this website. All copyrights and trademarks remain the property of their original owners.

Article 13Trademarks and Brand Disclaimer

Rethrowback Studio is not affiliated with, associated with, endorsed by, authorized by, or officially connected to any of the brands mentioned or sold on this website.

All product names, brand names, logos, and trademarks displayed on the Site remain the property of their respective owners and are used solely for identification and descriptive purposes.

The sale of second-hand or refurbished products does not imply any partnership, sponsorship, endorsement, or approval by the original manufacturers.

Article 14Applicable Law and Jurisdiction

These Terms and Conditions of Sale are governed by and interpreted in accordance with French law.

In the event of any dispute arising from the interpretation or execution of these terms, the parties shall seek an amicable resolution first.

If no agreement can be reached, the dispute will be submitted to the competent courts of France, specifically the jurisdiction where Rethrowback Studio’s registered office is located.
